The petition of appeal had not been signed by the registered attorney at law but suscribed to by the counsel who conducted case of the appellant in the original court instead. Upon preliminary objection being taken against the petition of appeal and conceded by the appellant that the petition had not been subscribed to by the registered AAL, it was held that the the petition did not constitute a valid appeal.
RANJITH SILVA, J.
A preliminary objection was taken by Mr. Vijithsingh that the notice of appeal was signed not by the registered Attorney but by a person called R.W. Seneviratne who was not the registered Attorney on record. We have perused the entire record and we find that there was never an application for a revocation of the proxy given to Mr. Nizar and there is no journal entry or proceedings authorizing the revocation and appointing a new Counsel as registered Attorney. We have not found a single proxy appointing Mr. A.W. Seneviratne or Mr. Priyantha Seneviratne as their Counsel. The only proxy that is there is one given to Mr. Nizar. Therefore the notice of appeal is defective, illegal and is fatal according to the cursus curiae laid down by the Superior Courts. Therefore we are constrained to dismiss this appeal, in limine.
